The principal characteristics of legislation governing bankruptcy in Latin America and the protection afforded security interests under such regimes are summarized in this publication. For such purposes, we have examined the bankruptcy laws and related doctrine of five countries in the region: Argentina; Brazil; Guatemala; Mexico; and Panama.We have reviewed the principal substantive and procedural aspects of the bankruptcy systems of each of the foregoing countries and the manner in which such systems treat security interests. This section provides a general and comparative overview of the approaches adopted by each country for purposes of providing an overall vision of the obstacles a secured creditor may encounter in the region.
